Maria Vasquez of San Antonio, Texas found herself the victim of an auto accident in May 2013. A driver ran a red light and subsequently hit Vasquez and her fiancé in the intersection. They suffered minor injuries including whiplash and their car was totaled. Her lawyer Adam Cortez discovered that the insurance company was offering Vasquez less because they considered her overweight at 5 foot three inches tall and 180 pounds. The insurance companies claim that overweight people have a pre-existing condition and don’t heal as fast as people at a healthy weight. The case continues under litigation.
